JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2018 Earlier prayer for bail of the petitioner was rejected on merit vide order dated 13.04.2017 passed in Cr. Misc. No. 17167 of 2017.

It has been submitted by learned counsel for the petitioner that he has not been identified by the victim girl and has falsely been made accused in this case and has been in custody since 10.02.2017 and is ready to abide by any condition imposed on him.

Considering the fact that prayer for bail of the petitioner has already been rejected on merit and, therefore, there is no occasion for this court to reconsider the prayer for bail of the petitioner, hence, I am not inclined to release the petitioner on bail, this

Patna High Court Cr.Misc. No.2894 of 2018 (2) dt.24-01-2018 2/2 application is, accordingly, dismissed.

However, since the petitioner has been in custody for about a year, trial court is directed to expedite the trial and try to conclude the same as early as possible preferably within a period of nine months.
