====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-08-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 341, 323, 325, 308, 354(B), 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, all the F.I.R. named accused persons, including this petitioner, assaulted informant with various weapons, as a result of which he sustained multiple injuries. Petitioner is alleged to have assaulted informant with butt of pistol.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Present case is counter blast of Civil Line P. S. Case No. 225 of 2022 lodged by the brother of petitioner against informant and others. F.I.R. has been lodged after delay of two days from the date of

Patna High Court CR. MISC. No.47873 of 2025(2) dt.12-08-2025 2/2 alleged incident, which itself raises doubt over veracity of the prosecution case. Allegation of assault is general and omnibus.

5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that there is specific accusation that this petitioner assaulted informant with butt of pistol and informant sustained 11 injuries. Doctor has found the injuries to be grievous in nature.

6. Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is refused.
