Petitioner, already in custody, seeks bail in connection with Forbesganj P.S. Case No.410 of 2017, giving rise to Sessions Trial No.382 of 2017, registered under Section 392 of the Indian Penal Code.

Allegation in brief is that while the informant was going to deposit Rs.4,00,000/- in the bank, four miscreants on the way robbed him.

Learned counsel for the petitioner submits that name of the petitioner was disclosed in the confessional statement of the co-accused Suraj Yadav and he has been in custody for last nine months; whereas the learned counsel for the State submits that the material against the petitioner is that he was identified

Patna High Court Cr.Misc. No.20376 of 2018(3) dt.09-04-2018 2/2 in the CCTV footage and also make confessional statement and a country made pistol with live cartridges were recovered from his possession, moreover he has also criminal antecedent of similar nature.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Forbesganj P.S. Case No.410 of 2017, giving rise to Sessions Trial No.382 of 2017, pending in the court of learned 3rd Additional Sessions Judge, Araria (Arun Kumar, J) S.KUMAR/- U T
