Singh, the learned senior counsel for the petitioner, Sri Sooraj Narain Pd. Sinha, the learned senior counsel for the informant and the learned APP. The petitioner was granted provisional bail till 15.09.2015 vide order dated 10.08.2015 for participating in the mediation to be held on 24.10.2015.

It is submitted that the mediation could not succeed as the petitioner, her husband and son did not agree to make payment of Rs. 55 lakhs. It is further submitted that Rs. 34 lakhs was paid to the petitioner and her husband through cheques. The petitioner handed over two cheques of Rs. 5 lakhs and Rs. 4 lakhs bearing cheque no. 315189 of A/C No. 3709214000004 and cheque no.

Patna High Court Cr.Misc. No.29661 of 2015 (3) dt.15-09-2015 2/2 916104 of A/C No. 158298022555 in the name of Savita Singh. The petitioner also undertakes to make payment of Rs. 25 lakhs and odd within six months from today.

Sri Suraj Narain Pd. Sinha, the learned senior counsel for the informant submits that of course the petitioner is a lady and if she makes payment of Rs. 34 lakhs including the two cheques of Rs. 5 lakhs and Rs. 4 lakhs as handed over he has no objection if the petitioner is granted bail.

Considering the facts aforesaid, provisional bail granted to the above named petitioner in Rupaspur P.S. Case No. 68 of 2015 to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur is hereby confirmed and the petitioner is allowed to remain on the same bail bond, subject to the condition that if the petitioner fails to deposit the remaining amount of Rs. 25 lakhs within six months, the court below shall cancel the bail bond of the petitioner.
