JUSTICE SUDHIR SINGH ORAL ORDER 23-08-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Trial No.388 of 2015 arising out of Motihari Town P.S. case No.67 of 2013 instituted for the offence under Section 387 of the Indian Penal Code, pending in the court of learned 9th Additional Chief Judicial Magistrate, East Champaran at Motihari.

Allegation against the petitioner is of demanding Rs.10 lacs as ransom from the informant for his organization, namely, Bihar People Libration Army Front.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.7.2013 and the charge sheet has already been submitted in the present case. Call received by the

Patna High Court Cr.Misc. No.22810 of 2016 (3) dt.23-08-2016 2/2 informant for ransom disclosed the name of the petitioner. Except for this, there is no other material against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R. and there are as many as 21 cases pending against him.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Court below is directed to take all necessary steps to expedite the trial.
