2. The petitioner seeks bail in connection with Lakhnaur P.S. Case No. 56 of 2024 registered for the offence under Sections 399, 402 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and others gathered at the house of one Karan Kumar Mishra, fired in the air and made a reel of the same and uploaded it on the social media account. One cartridge, one sword and two motorcycles have been recovered.

4. Learned counsel for the petitioner has submitted that the petitioner has no criminal history and he is in jail since 16.04.2024.

5. Considering the fact that the petitioner is not caught

Patna High Court CR. MISC. No.51024 of 2024(2) dt.02-08-2024 2/2 on the spot and there is no direct allegation of firing against him, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Jhanjharpur, Madhubani /concerned Court below in connection with Lakhnaur P.S. Case No. 56 of 2024.

7. As a condition of this order, the Court below, before accepting the bail bonds of the petitioner will verify the criminal antecedent/s of the petitioner. If the Court below finds that the petitioner has no criminal history then his bail bonds shall be accepted by the Court below. If the Court below finds that the petitioner has criminal history then appropriate orders shall be passed by the Court below.
