Petitioner apprehends his arrest in Banka P.S. Case No.145 of 2018, registered under Sections 419, 420 and 120(B) of the Indian Penal Code and 6/10 of Bihar Examination Control Act.

The informant, Centre Superintendent of the School, alleged that one Prem Kumar Das was appearing at the Bihar School Secondary Examination at Centre No.3208 in place of Badal Kumar Das bearing Roll Code No.32011, Roll No.1800028.

Learned counsel for the petitioner submits that Badal Kumar Das is own brother of Prem Kumar Das and Prem Kumar Das disclosed the name of the petitioner. Petitioner was

Patna High Court CR. MISC. No.46398 of 2019(2) dt.26-07-2019 2/2 not appearing at the examination but it appears that the petitioner set up his own brother to appear at the examination to fetch good marks in secondary school examination. Considering the facts and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
