JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-07-2019 The petitioner apprehends his arrest in connection with Makhdumpur P. S. Case No. 192 of 2019 registered under Sections 171C, 186, 188, 323, 332, 341, 353, 384,504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner, as per FIR lodged by the Town Executive Officer, Nagar Panchayat, Makhdumpur, is that while inspection work of drinking water, toilet and electricity etc. was being done, petitioner along with other accused persons abused the informant and told that they would not allow the contractor to work unless, he would be not paid money. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent having no criminal antecedent. He further submits that allegation is general and omnibus in nature and no Rangadari or money was demanded

Patna High Court CR. MISC. No.45594 of 2019(2) dt.24-07-2019 2/2 from the informant who is Government servant. He further submits that allegation of threatening on phone is against Kishori Singh and Vivek Singh and not on the petitioner. After having heard learned counsel for the parties and taking into consideration the fact that no specific allegation of demand of money from the informant is there and further the petitioner has got no criminal antecedent, accordingly, I am inclined to grant anticipatory bail to the petitioner. Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned SDJM, Jehanabad or his successor in connection with Makhdumpur P.S.Case No. 192 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
