JUSTICE BIRENDRA KUMAR ORAL ORDER 12-04-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 115,120(B) of the Indian Penal Code and Sections 25(1-A),25(1-AA), 25(1-B)A, 26(ii), 35 of the Arms Act.

A magazine containing 11 live cartridges of A.K.-47 rifle was recovered from possession of the petitioner and side by side and A.K.-47 rifle and 14 cartridges were recovered from co-accused Deepak Paswan. Petitioner is in custody since 19.08.2017. Petitioner has got criminal antecedent.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on completion

Patna High Court Cr.Misc. No.8689 of 2018 (4) dt.12-04-2018 of one year of custody, if the trial is not concluded in the meantime on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Trial No.2808 of 2017 arising out of Chhatauni Police Station Case No. 207 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
