The petitioners have preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code and sections 25(1-B)(a) and 26 of the Arms Act.
As per the prosecution case, four accused persons
Patna High Court CR. MISC. No.57515 of 2021(2) dt.07-04-2022 2/2 on the point of pistol snatched Rs.600/ from the possession of the informant. While two accused persons who are the petitioners herein were caught, two managed to escape. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. They were caught under a misunderstanding. Neither the pistol nor the stolen amount was recovered from the possession of the petitioners. The petitioners are in custody since 18.5.2021 and Rohan Kumar has no criminal antecedent. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioners having been caught at the place of occurrence itself, the Court is not inclined to enlarge the petitioners on bail and their application is rejected.
Liberty is granted to the petitioners to renew their prayer for bail after six months.
