JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 30-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 304 B of the Indian Penal Code.

Vide order dated 23.03.2021, a report was called for in this case regarding the stage of the trial and the time likely to be taken in conclusion of the trial. In compliance thereof, a report dated 01.04.2021 of the I/C A.D.J.-I, Banka has been received, which is at flag 'X'. In the report, the learned A.D.J.-I has stated that out of eight witnesses five witnesses have been examined. It is also stated that the case is pending for evidence of Doctor, I.O. and one non-official witness against whom

Patna High Court CR. MISC. No.3923 of 2021(4) dt.30-07-2021 2/2 summon is issued. It is lastly stated that the sessions case is likely to be concluded within three months.

In that view of the matter, I am not inclined to enlarge the petitioner on bail. However, the learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within six months. If the trial is not concluded within the stipulated period, as aforesaid, the petitioner may renew his prayer for bail.

Accordingly, the prayer for bail of the petitioner is hereby rejected.
