JUSTICE SANDEEP KUMAR ORAL ORDER 04-02-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 01.04.2022 in connection with Udakishunganj P.S. Case No. 204 of 2021 registered for the offence punishable under Sections 307, 34 of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner has submitted that the petitioner is said to have caused fire-arm injury to the injured, he has criminal antecedents also and is in custody since 01.04.2022.

Accordingly, this application for regular bail is allowed.

In view of the aforementioned facts and

No.49088 of 2022(3) dt.04-02-2023 2/2 circumstances, let the petitioner above named be released on bail after framing of charge if the charge in not framed yet or on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st Class, Udakishunganj, Madhepura in connection with Udakishunganj P.S. Case No. 204 of 2021.

The petitioner would cooperate in the proceeding of the Court below. If the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner. The petitioner is directed to appear before the Court below through his lawyer or himself on each date, failing which, his bail bonds shall be cancelled.
