Ms. Pushpa Sinha-1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-08-2021 Heard Mr. Binod Murari Mishra, the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Dehri (Indrapuri) P.S. Case No. 276 of 2020, dated 11.09.2020, instituted for the offences under Sections 143, 341, 307, 323, 354, 504 and 506 of the Indian Penal Code.

It is alleged in the F.I.R. that the accused persons assaulted the informant and his daughter.

The learned counsel for the petitioner has drawn the attention of this Court to the specific accusation in the

Patna High Court CR. MISC. No.5017 of 2021(2) dt.06-08-2021 2/3 F.I.R. that the petitioner assaulted the daughter of the informant. The daughter of the informant has received simple injuries. The informant also has received some injuries, but the nature of the same could not be assessed and further medical reports are awaited for assessing the nature of such injuries.

There is a counter version of the occurrence as well.

Mr. Mishra, the learned Advocate for the petitioner has submitted that from the narration in the F.I.R., it appears that there was a clash between two groups of people, where both sides have received simple injuries. The intention therefore, it has been argued, could not have been to cause any life threatening injury to any one of the victims. Regard being had to the background facts of the case, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to

Case No. 276 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
