2. The petitioners apprehend arrest in connection with Gaurichak P.S. Case No. 137 of 2026 lodged on 20.02.2026, for the offence punishable under Sections 69, 351(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioners. It has been alleged by the informant in the FIR that the main accused Jalim @ Sujit Kumar has developed physical relation with her in the name of marriage. Subsequently, took the

No.47869 of 2026(2) dt.22-07-2026 2/3 informant with him and gone to Jagdamba Temple near Karota and put vermilion in her head on the road stating that now he has solemnized marriage with her. The informant has further alleged that thereafter, the co-accused Jalim @ Sujit Kumar started ignoring and evading her and also switched off his mobile phone and when the informant's father went at the accused persons' house then the father and mother of co-accused Jalim @ Sujit Kumar misbehaved with him, abused him and petitioner no. 3 also threatened the informant's father. It is due to this reason, the present FIR has been lodged against accused Jalim @ Sujit Kumar and his relatives.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He submits that upon perusal of the entire FIR, the specific allegation is against co-accused Jalim @ Sujit Kumar and the petitioners are his relatives. Counsel submits that save and except using harsh words to the informant's father, there is nothing against the petitioners. He submits that the petitioners are respectable persons and they have clean antecedent and they are ready to fulfill all the conditions whatsoever shall be imposed upon them. He further submits that the case has been lodged primarily under section 69 of the B.N.S. and no

5. Learned APP for the State opposes the prayer for bail of the petitioners but fairly submits that the ingredient of section 69 of the B.N.S. is not applicable against the present petitioners.

6. As such, in the present facts and circumstances of this case, let the above named petitioners be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) each as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of A.C.J.M-II, Patna City, in connection with Gaurichak P.S. Case No. 137 of 2026, subject to the conditions as laid down U/s 482(2) of the B.N.S.S., 2023.
