Petitioner seeks bail in a case registered under sections 302, 328/34 of the Indian Penal Code.
Petitioner and four other FIR named accused took the deceased from the house and subsequently, it came to light that the deceased was taking treatment in the hospital but he died. Informant claims that the petitioner and two others got administered poisonous substance to the deceased.
Learned counsel for the petitioner submits that none has seen the actual killing of the deceased nor the informant claims to be eye-witness of so-called administration of poisonous substance to the deceased.
It is further submitted that having more or less similar allegation co-accused Purshottam Yadav has already been granted
Patna High Court Cr.Misc. No.23984 of 2016 (3) dt.15-07-2016 privilege of bail whereas petitioner is in jail custody since 23.5.2014. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Sultanganj P.S.
