Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-B)a, 26, 35 of the Arms Act. Four persons including the petitioner were apprehended on suspicion that they were preparing to commit dacoity. Nothing was recovered from possession of the petitioner. Rather recovery of firearm is from possession of co-accused Bhirkesh Kumar. The petitioner is in custody since 05.01.2018 and has stated on oath that he has got no criminal antecedent. Considering the aforesaid fact as well as the fact that investigation of the case is already complete, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.19193 of 2018 (2) dt.09-04-2018 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gwalpara Police Station Case No. 01 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
