This application, for grant of regular bail, arises out of Sono (Charkapathar) P.S. Case No.87 of 2013 (U.A.P. Case No.21 of 2015), disclosing offences under Sections 147, 148, 149, 427, 353 and 121(A) of the Indian Penal Code, Section 3/4 of Explosive Substance Act and Sections 16, 17, 18, 19, 20, 21 and 22 of the U.A.P. Act.
Learned counsel, appearing on behalf of the petitioner, referring the First Information Report,
Patna High Court Cr.Misc. No.22985 of 2016 (2) dt.24-05-2016 2/3 has submitted that implication of the petitioner in the present case is on the basis of secret information, which the police are said to have received from the villagers. It has been submitted that similarly circumstanced other co-accused persons, namely, Ravi Yadav, and Janki Yadav, have been granted regular bail by this Court vide orders, dated 22.06.2015, passed in Cr. Misc. No.18142 of 2015, and 10.11.2015, passed in Cr. Misc. No.51086 of 2015, respectively.
Considering the fact that similarly circumstanced co-accused persons have been granted the privilege of regular bail, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui, in connection with U.A.P. Case No.21 of 2015, arising out of Sono (Charkapathar) P.S. Case No.87 of 2013.
This is subject to the condition that the petitioner, abovenamed, shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to
