The petitioners apprehend their arrest in connection with Bakhtiyarpur P.S. Case No.147 of 2022 instituted under Sections 147,148,149,447,448,341,323,307,354,379 IPC. As per the prosecution story, the informant alleged that when her father-in-law was sitting at the door the petitioner no.2 came and assaulted him with 'Katta' on his head causing injury to him. Upon protest by the lady, allegation against the petitioner no.1 is of outraging her modesty as also snatching some amount.
Taking into account the kind of allegation that has come against petitioner no.2, Jitendra Singh, this Court is not
Patna High Court CR. MISC. No.48738 of 2022(2) dt.09-01-2023 2/2 inclined to grant him relief which accordingly stands rejected. So far as the petitioner no.1 is concerned, there is no accusation of assault, this Court is inclined to grant him relief. Let the petitioner no.1 namely Girish Singh @ Girish Kumar Sharma be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Bakhtiyarpur P.S. Case No.147 of 2022 to the satisfaction of learned Additional Chief Judicial Magistrate, III, Barh, Patna, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
