The petitioner seeks bail in a case under Section 386, 379 and other sections of the Indian Penal Code, section 27 of Arms Act, under section 3 (1) (x) of SC/ST Act and under section 3/5 of Public Property Damage Act.

The petitioner is named in the FIR along with other accused persons. The informant did not make any specific allegation against the petitioner. The informant alleged that the accused persons were collecting contribution for performing Sarswati Puja but the accused Rahul Kumar and Ranjan Kumar assaulted the informant and others and also abused Havildar Bharat Ram by naming his caste.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in Paharpur P.S.
