JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and others were caught while they had assembled to make preparation for committing dacoity. Moreover, only one mobile set is said to have been recovered from conscious possession of the petitioner and so far as recovery of firearms is concerned, the same has been recovered on the basis of confessional statement of co-accused.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Muzaffarpur in connection with Kudhani P.S.Case No. 64 of 2016.
