The petitioner who was appointed in the year 1968 and retired on 31st March, 2013 has preferred this writ petition praying for direction to the respondent authority for grant of pay scale of Rs. 5000- 8,000/- i.e the lowest pay scale of the Research Assistant after grant of first promotion under the

Patna High Court CWJC No.10745 of 2023(7) dt.08-02-2024 2/2 A.C.P Scheme with effect from 09.08.1999. He also seeks direction for next higher pay scale of Research Assistant Officer i.e 5500-9000/- after grant of next higher pay scale of Research Assistant Officer under A.C.P Scheme with effect from 09.08.1999.

3. The present writ petition was filed in the year 2023 which is after 10 years of the petitioner's retirement from the service as Gauze Reader.

4. In view of the fact that the writ petition has been filed with the aforesaid prayer after 10 years of the retirement of the petitioner, this Court is not inclined to entertain this writ petition on the ground of delay and laches in approaching this Court.

5. Accordingly, the writ petition is dismissed on the ground of delay and laches in approaching this Court. (Nani Tagia, J) Prakash/- U
