This application for anticipatory bail arises out of Maharajganj P.S. Case No. 16 of 2020 for the offence punishable under Sections 341, 323, 324, 307, 452, 379 and 504/34 of the Indian Penal Code.
At the very outset, learned counsel for the petitioner has offered to pay Rs.10,000/- to the prosecution side for treatment.
It is submitted by learned counsel for the petitioner that the petitioner is not the assailant, so he deserves anticipatory bail.
Considering the fact that the dispute is of trivial nature and the petitioner is not the assailant, this application is allowed. Let the petitioner, above named, in the event of his
Patna High Court CR. MISC. No.2499 of 2021(4) dt.24-11-2021 2/2 arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Maharajganj P.S. Case No. 16 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is also subject to the condition that at the time of furnishing the bail bond, the petitioner shall deposit an amount of Rs.10,000/- in the Court below and the Court below, in turn, will give the said amount to the informant. (Sandeep Kumar, J) pawan/- U T
