JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Ekchari (Kahalgaon) P.S.Case No. 24/2015, disclosing offences under sections 25(1-b)a, 26, 35 of the Arms Act. Learned counsel for the petitioner has submitted that in a raid conducted by the police, four persons were apprehended including the petitioner, from whose possession one country made pistol and eleven live cartridges were recovered. He has submitted that from the possession of co-accused Kailash Yadav, one country made pistol and 23 live cartridges were recovered, who has been granted regular bail by this Court vide order dated 16.5.2016 passed in Cr.Misc.No. 20684/2016.

Considering the fact that similarly circumstanced co-

Let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Bhagalpur in Ekchari (Kahalgaon) P.S.Case No. 24/2015. This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
