The petitioner seeks regular bail in connection with Nabinagar P.S.Case No. 59 of 2014, registered under Section 395 of the Indian Penal Code.
The F.I.R. has been lodged on the basis of the written report by the informant in which he has stated that he is a sales man and on 04.05.2014, two unidentified miscreants forcibly got open the door of shop by putting him in fear of death pointing arms towards him and they took cash of Rs. 10,000-12,000/- and mobile giving threats they decamped and thereafter they committed dacoity in the house of another person also. Patna High Court Cr.Misc. No.2661 of 2018 (3) dt.13-02-2018 2/2 petitioner that the F.I.R. is against unknown and his name has transpired in this case on the basis of confessional statement made by one co-accused, Santam Kumar Pawan except that there are no other incriminating materials against the petitioner. It has been further stated that similarly situated coaccused, Santan Kumar Paswan and Govind Kumar @ Raj Verma have been granted bail vide order dated 23.01.2015 passed in Cr. Misc. No. 3210 of 2015 and order dated 29.01.2015 passed in Cr. Misc. No. 3723 of 2015.
Having considered the said facts and circumstances, let the petitioner, Surajmal Paswan, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S.Case No. Case No. 59 of 2014.
