The petitioner seeks bail in connection with Bagha P.S. Case No. 645 of 2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned counsel for the petitioner submits that the petitioner is in custody since 02.07.2021 and charge-sheet has been submitted in the case.
Learned counsel for the petitioner submits that allegation is of recovery of 126.125 litres of liquor and he came to be implicated in the present case based on secret information received by the police that this petitioner along with other
Patna High Court CR. MISC. No.58945 of 2021(2) dt.07-01-2022 2/2 named accused persons were coming to take delivery of liquor. Learned counsel for the petitioner submits that the petitioner was not apprehended at the spot and his name transpired based on secret information received by the police though nothing was recovered from his conscious possession. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 02.07.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand only) with two sureties of the like amount each to the satisfaction of Shri Pawan Kumar Pandey, learned Spl. Judge, Excise, Bettiah, West Champaran in connection with Bagha P.S. Case No. 645 of 2020.
