The petitioners seek bail in a case registered for the offences punishable under sections 392 of the Indian Penal Code. Later on section 395 of the Indian Penal Code was added. The petitioners are not named in the F.I.R. The name of the petitioners figured in the case on the confessional statement of co-accused Raju Kumar Raj, who confessed that he along with 10 accused persons committed dacoity. It is submitted that Manish Yadav, Sonu Singh, Bimlesh Kumar and Pankaj Singh have already been enlarged on bail and the case of the petitioners stands on the same footing. It is

Patna High Court Cr.Misc. No.31448 of 2015 (2) dt.17-08-2015 also submitted that the learned Sessions Judge has taken note of the CC TV footage in his order but no paragraph of the case diary has been referred to in the impugned order. The case of the petitioners stands on the same footing.

Considering the facts aforesaid, let the petitioners above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Industrial P.S. Case no. 31 of 2014.
