Petitioner seeks bail in a case registered for the offences punishable under Sections 409, 419, 420, 467, 468 and 471 of the Indian Penal Code.

Submission of the learned counsel for the petitioner is that co-accused Abhinay Kumar, who is named in the FIR and is alleged to have opened fake bank account by producing forged document has already been allowed provisional bail vide order dated 10.03.2017 passed in Cr. Misc. No. 8369 of 2017 by a Coordinate Bench of this Court by a reasoned order with direction to Abhinay Kumar to deposit Rs.2,50,000/- with the bank within the time allowed.

Patna High Court Cr.Misc. No.10821 of 2018 (2) dt.27-02-2018 2/2 Allegation against the petitioner is that the petitioner had deposited a cheque said to be issued by Kavita Srivastava in his account and subsequently the petitioner had withdrawn the same. However, on 12.11.2016, the petitioner had deposited Rs.3,00,000/- in his account vide Annexure-2 of the bail petition.

Now the said bank account of the petitioner has already been freezed by the bank. Petitioner is in custody since 30.10.2017 and has got no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bettiah Town Police Station Case No. 599 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
