The petitioner is in custody in a case registered for the offence punishable under Sections 25(1-b)a and 26 of the Arms Act Act and Sections 20/22 of the NDPS Act.

Allegedly, it is a case of recovery of one country made pistol, one live cartridge as well as one kilogram of charas from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that there is no recovery from the possession of the petitioner and petitioner is in judicial custody since 27.03.2021. Learned APP appearing for the State has vehemently opposed the prayer for regular bail of the petitioner and

Patna High Court CR. MISC. No.48622 of 2022(3) dt.12-01-2023 2/2 submitted that one country made pistol and one live cartridge as well as one kilogram of charas have been recovered from the possession of the petitioner and the said charas is of commercial quantity.

After having the facts and circumstances of the case, I am not inclined to grant regular bail to the petitioner. Prayer for regular bail of the petitioner is rejected. However, the trial Court is directed to conclude the trial expeditiously.
