Mr. Prem Kumar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-07-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 447, 448, 341, 323, 379, 307, 34 of the Indian Penal Code.

No.60028 of 2021(3) dt.06-07-2022 2/3 It is alleged that in the background of a petty dispute, all the F.I.R named accused persons including the petitioners variously armed entered into the house of the informant and started assaulting him and when son of the informant came to his rescue, co-accused Rahul Pandey assaulted with knife on his head. The other accused persons assaulted the family members of the informant and snatched gold chain and cash of Rs. 45,000/-.

It is submitted by learned counsel for the petitioners that there is general and omnibus allegation against the petitioners. It is specifically alleged that petitioner No. 7 assaulted Seraj Alam by means of iron rod but there is no injury report on record with regard to Seraj Alam. The specific allegation of making assault with knife to the son of the informant is against Rahul Pandey who is not petitioner before this Court. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

No.60028 of 2021(3) dt.06-07-2022 3/3 In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S. Case No. 527 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
