Mr.Rajiv Nayan ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-02-2022 Heard learned counsel for the petitioner and the State. The matter has been taken up through video conferencing.

The petitioner seeks bail in a case registered under section 436/120B and other sections of the Indian Penal Code, sections 3 and 4 of the Explosive Substance Act and sections 13, 16, 18, 19, 20 and 38 of the U.A.P.A. Act.

As per allegations in the F.I.R., a group of accused persons belonging to a Naxalite group attacked the 25 M.W Sawkala Power Plant at Gaya taking the employees as hostage on gun point. Accused persons placed detonators and exploded the constructions of the Plant.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.58813 of 2021(2) dt.07-02-2022 2/2 petitioner's name has figured during course of investigation in confessional statement of co-accused Sanjay Das. Test Identification Parade has not been carried out till date. Similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court vide order passed in Cr. Misc. No. 15796/2021. Petitioner is in custody since 24.07.2020. Investigation in the case is complete.

Having heard learned counsel for the parties and taking into consideration the period of custody of the petitioner, the Court directs the petitioner, as named above, to be enlarged on bail in connection with Chhakarbandha Police Station Case No. 196 of 2017 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
