2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Mejarganj P.S. Case No. 186 of 2023 instituted for the offence under Sections 399/402 of the IPC and Sections 25(1-b)a, 26/35 of the Arms Act.

3. As per allegation in the FIR, some miscreants are alleged to have assembled for preparation of offence thereafter, police raided the place of occurrence near the poultry farm of co-accused Chandan Kumar but all of them succeeded to flee away. Upon search, some arms and vehicles were recovered from there.

4. Learned counsel for the petitioner submits that the

The petitioner has no concerned with the alleged arms seized by the police or with the place of occurrence. He has been falsely implicated in this case. It is further submitted that owner of the poultry farm namely, Chandan Kumar has already been enlarged on bail by this Court vide order dated 21.6.2024 passed in Cr. Misc. No. 24834 of 2024.

5. Learned APP appearing for the state has opposed the prayer of bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Mejarganj P.S. Case no. 186 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, Sitamarhi subject to the conditions as laid down under section 438(2) of the Cr.P.C.
