In the counter affidavit, it has been admitted by the complainant that only Rs. 50,000/- has been paid to him but so far as rest amount is concerned, the complainant disputes the assertion of the petitioner.

The factum of payment in question can only be determined in course of trial. Moreover, petitioner is in jail custody since 14.05.2015 in a case which is triable by the Magistrate.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.32565 of 2015 (3) dt.21-09-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Anil Kumar Ram, Judicial Magistrate 1st Class, Patna in connection with Complaint Case No. 2651 C of 2012.
