Petitioner is accused in connection with Chapra Muffasil (T) P.S. Case No. 41 of 2016 registered under Sections 147,148, 341, 342, 323, 307 and 302/34 of the I.P.C. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the truck which was being driven by the deceased Mritunjay Pandey with which the informant was Khalasi, dashed two boys, who were on bicycle. Thereafter, the driver moved the truck in high speed and stopped the truck in Sai Hotel near Jalalpur. The informant and truck driver reached near Hotel. In the meantime, 15 to 20 unknown persons suddenly came in Tempo with lathi, bricks and stones and

Patna High Court Cr.Misc. No.21925 of 2016 (3) dt.27-07-2016 2/2 started assaulting to him and the driver, while he succeeded to flee away and the driver of the truck was brought to the hospital where he died during treatment. It is also submitted that prior to this case, Mufassil P.S. Case No. 40 of 2016 was instituted by the Chowkidar of the Police Station against the driver of Truck for dashing. It is further submitted that petitioner is father of one boy who was dashed doing the work of contractor due to that reason he has falsely been implicated in this case. In fact, it was the mob who assaulted the driver of truck, who died later on. Further, submission is that after investigation charge has already been submitted and the petitioner, having no criminal antecedent, is in custody since 08.02.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Saran at Chapra in connection with Chapra Muffasil (T) P.S. Case No.41 of 2016.
