JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration that petitioner is said to have raped the victim girl, who appears to be minor, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Dinara P.S.Case No. 39 of 2014, pending in the court of Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas stands rejected.

However, it appears that the case of the petitioner is still pending before the Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas for disposal and if it is so, the concerned court must commit the case of the petitioner to the court of session within four weeks from the date of receipt/ production of copy of

Patna High Court Cr.Misc. No.33374 of 2015 (3) dt.16-10-2015 2/2 this order and after that the concerned sessions court shall expedite the trial of the petitioner and try to conclude the same as early as possible.
