The petitioner apprehends his arrest in Bousi P.S. Case No.136 of 2015 registered under Section 353 and other Sections of the Indian Penal Code.

The constable of the police station alleged that petitioner and others had come to the police station and inquired about the Station House Officer. The petitioner and others are alleged to have torn the papers and also threatened to set ablaze the police premises if the accused of Bousi P.S. Case No.133 of 2015 is not arrested.

The learned counsel for the petitioner submits that cousin of the petitioner was killed for which Bousi P.S. Case No.133 of 2015 was registered. The police officer called the

Patna High Court Cr.Misc. No.392 of 2018 (2) dt.16-01-2018 petitioner and others for taking their statements but the police did not take their statements on such, the petitioner made peaceful protest that is why the petitioner and others have been falsely made accused in the case.

Considering the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Araria in connection with Bousi P.S. Case No.136 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
