JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 15-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Baligawn P.S. Case No. 33 of 2017 registered under Sections 341, 323, 354 and 504 of the Indian Penal Code.

Petitioner is said to have tried to outrage the modesty of the informant's daughter, who is dumb, when she has gone to cut the grass from field.

It is submitted by learned counsel for the petitioner that victim was cutting the crops from the petitioner's field and when he forbade her, informant lodged this false case. Petitioner has no concern with the aforesaid occurrence and has been falsely implicated in this case. Victim in her statement recorded under

Patna High Court Cr.Misc. No.7390 of 2018 (3) dt.15-03-2018 2/2 Section 164 Cr.P.C. has not make allegation of rape against the petitioner. Doctor has also not found any sign of rape in medical examination. Petitioner is languishing in judicial custody since 20.07.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, XIIth Vaishali at Hajipur in connection with Baligawn P.S. Case No 33 of 2017.
