The petitioners seek bail in a case registered under Sections 420, 467, 468, 379, 323 of the Indian Penal Code. Allegation is that the accused persons forcibly took Away the thumb impression of the informant on a paper and also assaulted her. They also took away the papers relating to her land.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 1.6.2019 and have got no criminal antecedent. There is no allegation of tampering of
Patna High Court CR. MISC. No.45569 of 2019(2) dt.23-07-2019 2/2 witnesses alleged against the petitioners. The matter relates to civil dispute. There is land transaction between the parties. Mutation has already been done in favour of the petitioners and the rent receipts are also in favour of the petitioners. On behalf of the State, it is submitted that the petitioners are named in the complaint case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Masaurhi, Patna in connection with Complaint case No.63(c) of 2018.
