2. The petitioner apprehends her arrest in connection with Nanpur P.S.Case No. 60 of 2024 dated 13.02.2024 instituted for the offence punishable under Sections 363, 366A, 323, 504/34 of the Indian Penal Code.
3. The prosecution case, in short, is that the petitioner is involved in the conspiracy of kidnapping of informant's daughter.
4. Learned counsel for the petitioner submits that informant's daughter and petitioner's son Chintu fell in love with each other and both are living together and leading their
Patna High Court CR. MISC. No.50669 of 2024(2) dt.21-08-2024 2/3 conjugal life. It is further submitted that the daughter of the informant is aged about 18 years. It is further submitted that earlier the parents of the victim lodged case bearing Nanpur P.S.Case No. 456 of 2023. The learned S.D.J.M, Pupri while considering the bail application of co-accused Ram Babu Sahni considered that the accused Chintu Kumar and victim Sita Kumari were living together and leading their happy conjugal life and both are major and also considered the Adhar Card of both the petitioner and victim and granted him bail. It is further submitted that petitioner has been made accused only on the basis that she is mother of main accused Chintu Kumar. The petitioner has one criminal antecedent which was lodged by the present informant.
5. Learned A.P.P for the State has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of the learned counsel for the parties, in the event of arrest/ surrender of the petitioner within a period of six weeks from today, in connection with Nanpur P.S.Case No. 60 of 2024, she will be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the
Patna High Court CR. MISC. No.50669 of 2024(2) dt.21-08-2024 3/3 learned S.D.J.M, Pupri at Sitamarhi, subject to condition as laid down under Section 438(2) of the Cr.P.C.
