Petitioners apprehend arrest in connection with Rasulpur P.S. Case 60 of 2020 registered for the offence punishable under sections 323, 504, 307/34 of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. The informant and petitioner no. 1 are full brothers. Petitioner nos. 2 to 4 are nephew of the informant. There is admitted land dispute between the parties. The injuries
Patna High Court CR. MISC. No.4826 of 2021(2) dt.07-12-2021 2/2 sustained have been found to be simple in nature. Petitioners have clean criminal antecedent.
Learned Addl. P.P. appearing for the State submits that there is direct allegation of giving farsa blow on the petitioner no. 1 which is supported by the injury report. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner nos. 2 to 4, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Chhapra, Saran in connection with Rasulpur P.S. Case No. 60 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C. So far as petitioner no. 1 is concerned, considering the nature of allegations levelled against him which is supported by the injuries sustained, this Court is not inclined to grant him the privilege of anticipatory bail.
