JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 The petitioners are apprehending their arrest in connection with Sahebganj P.S. Case No. 52 of 2015 for the offences instituted under Sections 307, 379, 448, 504/34 of the IPC and 25(1-B)A of the Arms Act.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that six persons armed with weapon riding on two motorbikes arrived at his door. They disconnected the generator wire. Informant identified five of them in torchlight. They abused the informant and they started taking away the motorcycle of informant. Informant raised alarm on which people assembled there and with the help of them, three

Patna High Court Cr.Misc. No.30903 of 2015 (2) dt.30-07-2015 2/2 persons were apprehended with country made pistol and motorcycle. The police was informed who came and apprehended persons were handed over to police.

It has been submitted on behalf of the petitioners that the petitioners have no criminal antecedent. It is further submitted that the allegation of firing is against co-accused Moti Ram which did not hit any one. As far as the petitioners are concerned, there is no allegation of causing injury to any one in course of occurrence. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Sahebganj P.S. Case No. 52/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
