KUMAR ORAL ORDER 20-02-2018 Heard learned counsel for the petitioners and leaned Additional Public Prosecutor of the State.
The petitioners are apprehending their arrest in connection with Alamganj P.S.Case No. 57 of 2017, registered for offences punishable under Sections 328 and 302 of the Indian Penal Code.
The informant has alleged that the petitioners have killed her husband by administering poison and have cremated the dead body at Khajekala Ghat, Patna. It is further alleged that her husband was interested in keeping her where as her in-laws family were opposing her husband including the petitioners and used to quarrel and the informant believes that her husband has been killed by accused persons due to property dispute.

No.2603 of 2018 (3) dt.20-02-2018 2/2 It has been submitted that petitioners are brother- in -law (Devar), who is student and mother-in-law of the informant, who is old lady, as mentioned in para-6 of the bail petition and the petitioners have been falsely implicated in this case. It is also submitted that similarly situated co-accused have been granted bail by a Co-ordinate Bench of this Court vide order dated 18.01.2018, passed in Cr. Misc. No. 61384 of 2017 and the allegations against the petitioners are general and omnibus. Learned Additional Public Prosecutor opposes the prayer of bail.
In such circumstances, prayer for anticipatory bail is allowed and it is ordered that the petitioners, named above in the event of their arrest or surrender before the Court below within a period of six weeks, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each in connection with Alamganj P. S. Case No. 252 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, subject to the conditions laid down under Section 438 ( 2) Cr. P. C.
