The petitioner has been in custody since 27.05.2017 in connection with Ahiyapur P.S. Case No. 377 of 2017 for the offence registered under Sections 302 of the Indian Penal Code. Learned counsel for the petitioner submits that the present petitioner is a happily married person with no extra marital relationship but only on suspicion the husband of the deceased lady has leveled this frivolous allegation. Even in the case diary, there is no evidence to show that the petitioner was having any relation with the wife of the informant. It is further submitted that on mere suspicion the petitioner has falsely been implicated in this case.

Patna High Court Cr.Misc. No.7522 of 2018 (3) dt.27-02-2018 Considering the aforesaid facts and circumstances of the case and the period of custody and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzuffarpur in connection with Ahiyapur P.S. Case No. 377 of 2017.
