The petitioner seeks bail in a case registered for offences under Sections 30 (A)(B)(C) and 37(C) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 60 litres of Mahua wine was recovered from the tempo which was being boarded by three persons including the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 22.01.2018.

Considering the facts and the circumstances of the

Patna High Court Cr.Misc. No.20390 of 2018(2) dt.19-04-2018 2/2 case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Special Case No. 543 of 2018 arising out of Phulwari Sharif (Janipur) P.S. Case No. 43 of 2018 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
