The petitioner seeks bail in Bidupur P.S. Case No. 210/2019, instituted for offence under Section(s) 393 and 414 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence while informant was returning after withdrawing money from Allahabad Bank and reached near Gandhi Chowk, two unknown miscreants came on motorcycle and tried to snatch the cash of Rs. 1 lac, kept in bag. It is alleged that petitioner was apprehended by villagers. Other person managed to run away.
Learned counsel for petitioner has submitted that from the written report it appears that petitioner was apprehended on
Patna High Court CR. MISC. No.45181 of 2019(2) dt.24-07-2019 2/2 the spot but no incriminating article has been recovered from his possession.
Petitioner is in custody since 28.05.2019 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 210/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
