JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-12-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Banshi P.S. Case No.58 of 2017 registered under Sections 341, 323 and 307/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that there is a case and counter case and members of both sides sustained injuries. He submitted that scuffle took place between the parties because of ongoing land dispute and the petitioners are sufficiently old persons having no criminal antecedent. Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners.

Having regard to the facts and circumstances of the case

Patna High Court Cr.Misc. No.58728 of 2017 (2) dt.13-12-2017 2/2 and the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Mr. Arun Kumar, learned A.C.J.M.-1st, Arwal in connection with Banshi P.S. Case No.58 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
