JUSTICE ARUN KUMAR ORAL ORDER 14-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Khodabandpur PS Case No. 168 of 2014 (Sessions Trial No. 325 of 2016) registered under Sections 302/34 of the IPC and Section 27 of the Arms Act. Learned Counsel for the petitioner submits that the FIR is against unknown and the allegation is that three motorcycle borne criminals shot at the informant's son sitting in the shop, whereas number of persons have been made accused, the only material against the petitioner is disclosure of his name by two co-accused Arun Yadav and Manoj Yadav. who were admitted to bail by a coordinate Bench of this Court and later on they were acquitted on conclusion of the trial.
Having considered the said facts and circumstances, the petitioner, namely, Nagmani Mahto is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Dharamshil Srivastava, Additional Sessions Judge V Begusarai in connection with Khodabandpur PS Case No. 168 of 2014 ( Sessions Trial No. 325 of 2016) with the following conditions:-
Patna High Court Cr.Misc. No.6559 of 2018 (3) dt.14-03-2018 (i) One of the bailors must be a close family members of the petitioner; and (ii) The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
