JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Athmalgola P.S. Case No. 266 of 2017 registered for the offence punishable under Sections 448, 341, 323, 379, 354, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the accused persons including the petitioners herein is assaulting the prosecution side as well as firing gun shots on the prosecution side resulting in various types of injuries but the said injuries have been inflicted by gun shots. No.2777 of 2018 (3) dt.24-01-2018 2/3 accused persons have been granted bail by the concerned court considering the fact that the present case arises out of case and counter case and the said accused persons who have been granted bail have clean antecedent. The learned counsel for the petitioners further submits that as far as the antecedent of the present petitioners is concerned, they have been acquitted in all the cases barring one in which they are on bail. It is further submitted that the petitioners herein have been falsely implicated in the present case and they are ready to abide by any terms and condition so imposed by this Court.

Having regard to the facts and circumstances of the of the case, I deem it fit and proper to enlarge the petitioners herein on anticipatory bail in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Barh in connection with Athmalgola P.S. Case No. 266 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

It is directed that the petitioners herein would mark their attendance at 10:00 A.M. on every Monday of each week

No.2777 of 2018 (3) dt.24-01-2018 3/3 before the Officer In-Charge of the concerned Police Station and two consecutive defaults to mark such attendance, the present privilege of anticipatory bail granted to the petitioners would stand cancelled automatically and the petitioners would be taken into custody forthwith.
