The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE AMARESH KUMAR LAL ORAL ORDER 17-08-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-a), 25(1aa), 25(1-b) AC, 26 (i)(ii)(iii) and 35 of the Arms Act and Sections 16, 18, 20 and 25 of Unlawful Activities (Prevention) Act.

The allegation is that the police conducted a raid and four persons were apprehended who disclosed the name of the other accused including the petitioner. It is submitted that nothing has been recovered from the possession of the petitioner nor the petitioner has been apprehended on the spot. In similar facts and circumstances, co-accused Md. Mushtaque has been granted bail vide Cr. Misc. no. 29603 of 2015. The petitioner has been in custody since 5.1.2015 having no criminal antecedent.

Considering the facts and circumstances of this case, the above-named petitioner is directed to be

No.32780 of 2015 (2) dt.17-08-2015 2 / 2 released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Munger, in Muffasil P.S. Case No. 216 of 2013, G.R. no. 1918 of 2013 with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence on two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
