The petitioner, who is in custody since 23.07.2021, seeks bail in connection with Tetarhat P.S. Case No. 74 of 2021 dated 23.07.2021 instituted for the offence under Sections 353, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act and Section 37(C) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

The petitioner is said to have been arrested on hot chase and was found to be inebriated. While fleeing away, the petitioner along with his associates is also alleged to have opened fire which did not hit anybody.

Learned counsel for the petitioner has submitted that there was no recovery of firearms on the arrest of the petitioner

Patna High Court CR. MISC. No.58666 of 2021(2) dt.23-05-2022 2/2 and there was also no recovery of liquor from his possession. Nobody, he reiterates has been injured in the occurrence. The petitioner is in custody since 23.07.2021 and two of the other accused persons of this case having similar allegation against them have been granted bail by a Bench of this Court.

Considering the afore-noted facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge Excise, Lakhisarai in connection with Tetarhat P.S.
