JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 392 of the Indian Penal Code. The prosecution case, in short, is that on 6.11.2015 two unknown culprits intercepted the informant and committed loot of Rs.36,680/- along with his motorcycle and also assaulted him.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.2.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has come in the confessional statement of co-accused. The petitioner has not been

Patna High Court Cr.Misc. No.22513 of 2016 (3) dt.18-08-2016 2/2 put on Test Identification Parade. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Mansi P.S. case No.214 of 2015.
